We would like to present to you below our General Terms and Conditions of Sale which aim to define the conditions under which Superbath processes orders placed on the www.superbath.co.uk website.
1.1.These terms and conditions are in place to protect you and iSi GmbH, the operating company of SuperBath.co.uk.
Here we detail our commitment to you and provide a few simple guidelines to make your purchase as smooth as possible. SuperBath.co.uk works extremely hard to ensure that our prices are kept as low as possible. In order to continue offering all of our customers these low prices, please take a minute to read through the terms and conditions below, before you complete your purchase with SuperBath.co.uk
If you are unsure or have any issues with our terms and conditions outlined below, please do not hesitate to email our customer support team who will be more than happy to answer your queries by reply and keep any enquiries on file. Please read all sections of the terms and conditions thoroughly. By placing an order through our website, you are accepting the terms and conditions explained below. If you do not agree to these terms then you may not use our site.
1.2. The term "consumer" used in these GTCs refers to a natural person placing an order that does not fall within the scope of his or her commercial or liberal professional activity. A "business consumer" as used in these GTC is a natural or legal person who, when placing an order, is acting in the context of and on behalf of his or her professional or business activity. The term "customer" may refer to a consumer as well as a professional.
2. Your customer status
By placing an order through our site, you warrant that:
● You are legally capable of entering into binding contracts
● You are a resident in the UK
● You are accessing our site from the UK
3. Delivery of goods
The delivery of goods to you is deemed to be a separate contract for services, distinct from your contract to purchase the goods.
Delivery dates are approximate and no liability whatsoever is accepted in respect of late deliveries. Do not arrange for a plumber to install the items until they have been delivered and checked for discrepancies and to make sure they are undamaged.
If for any reason expected delivery will exceed 14 days from the date of receipt of order the customer will be informed and given the opportunity to cancel the order.
Without prejudice to the statutory rights afforded to consumers under English law, iSi GmbH accepts no liability for any failure to ship products where this results from its inability to do so resulting from acts of god, civil commotion, riots, flood, drought, fire, legislation or other factors outside its control, or its decision on reasonable grounds not to do so for reasons of suspicion of credit card fraud or similar, provided that it takes all reasonable steps to notify you within fourteen (14) days of order placement that products will not be shipped as ordered.
3.1. Small and Medium items via GLS and the Royal Mail
Goods are delivered by Royal Mail and may require a signature upon delivery. We put all of our goods on a first class service; however please allow up to 6 days for delivery after dispatch notification.
3.2. Large items via courier
The couriers will attempt delivery at your address, if no one is available to sign for the goods, a card will be left for you to contact the couriers to collect from the local depot. The couriers may attempt delivery the following day, but they do not guarantee this second attempt. Goods delivered by courier will require a signature upon delivery. Please be advised, a telephone number is required so that we can arrange the delivery of some items. Any failure to provide a valid contact number at the point of purchase may cause significant delay to delivery. SuperBath.co.uk will dispatch your item to our courier ready for delivery and email you confirming this. Our transport company will then call you to arrange delivery of your purchase, this will be within 48 hours of dispatch, and you will be able to arrange a suitable day for your delivery. Goods delivered by our transport company will require a signature upon delivery. Due to the fragile nature of most extra large items, we ask that all items are checked for any obvious signs of damage before you sign for the goods. Any items with significant damage must be refused and signed for as damaged.
3.3. Damaged products
The customer is requested to check the condition of the goods at the time of delivery. Any damage caused by the carrier, lack of items or parts, manufacturing defect or any other anomaly that occurred before receipt of the package, must be reported to our SuperService by phone or via E-mail within 3 days after receipt of the order. Please understand that any claim made outside this time limit will be rejected.
4. Cancellation rights
You can cancel an order placed with SuperBath.co.uk up to 14 working days after placing it. Just send an email to the after sales team requesting the cancellation. If the item has not been delivered the order will be cancelled and a refund processed. If the item has been dispatched we will process the refund when the item has been returned to us.
Please see returns for more information regarding delivered items (see below). All cancellations must be submitted by email, as written confirmation is needed for this to be processed. Cancellations and refunds cannot be dealt with by telephone.
5. Returns and refunds
5.1. Our customers have a period of fourteen (14) full days from receipt of the items to exercise their right of return without having to justify their reasons or pay any penalties. No right of withdrawal exists for products made to the customer’s specifications or are clearly personalised or which, due to their nature, cannot be returned or are likely to deteriorate or expire quickly.
5.2. No right of return exists for business customers.
5.3. For any return of goods, the customer must first contact SuperBath to inform us of your wish to return the product. Please make sure to include your name and order number with the returned items.
5.3.1. A return by parcel is required for all goods that have reached the customer as a parcel. The goods must be returned in their original packaging, complete and in perfect condition so that they can be sold as new.
You have the right to open the packaging and handle the delivered products but the products must not have been installed or used. If items are returned without their original packaging or with substantial damage to manufacturer packaging, additional costs might apply.
You will be responsible for the return of the products and all costs associated with this.
We offer the possibility to use a return label generated by us. We will not accept or refund any items that are damaged whilst in your possession or in transit back to us.

5.3.2. A return by pallet is required for all goods that have reached the customer on a pallet. We don’t offer a return label for these products, but we are happy to assist you if you wish to return your product. Please contact our customer service team at [email protected]. You will be responsible for the return of the products and all costs associated with it.
5.4. If you exercise your right of return within the permitted period, we will refund the money to the same means of payment that you used to place your order (if technically possible). We will make the refund as soon as possible and at the latest within thirty (30) days following the date on which the right of withdrawal was exercised.
6. Product Guarantee
In order to mitigate any problems and ensure an effective resolution, we ask that the customer fully inspect all products received on the day of delivery. The customer is required to notify SuperBath of any items that arrive faulty or damaged within the first 3 working days of receipt of goods.
Please contact our customer service team who will advise the best course of action. Never dispose of any items unless instructed to do so by SuperBath. Please note: All faulty items will be analysed by the manufacturer. If they determine that there is no fault or that the fault/s have been caused by damage or abuse, then the warranty claim will be void. In this case, the goods will be returned and no refund or replacement will be issued.
6.1. Warranty and Guarantees
Many of the products offered have Manufacturer Guarantees for periods longer than 12 months, however, in these cases the period listed is still a Manufacturer Guarantee. If any item develops a fault within the manufacturer's warranty period, we ask that you contact SuperBath, who will advise you on the next steps. Manufacturers all have different procedures for dealing with faults and warranty claims. For some manufacturers we will organize the replacement of goods on their behalf, however some companies prefer to deal with customers directly. In these instances, we will provide you with all the relevant contact information for the manufacturer. They will then be able to arrange for the repair, replacement or advise an alternative way forward. Never dispose of any items nor send them back unless instructed to do so by SuperBath or the manufacturer. Please note: All faulty items will be analysed by the manufacturer. If they determine that there is no fault or that the fault/s have been caused by damage or abuse, then the warranty claim will be void. In this case, the goods will be returned and no refund or replacement will be issued.
7. Risk and property
Responsibility of damage to or loss of goods shall pass to the customer:
● As soon as goods are collected from our warehouse by the customer
● As soon as goods are delivered to the customer's address
Notwithstanding delivery and the passing of responsibility for the Goods to you, the transfer of the ownership of the Goods shall not take place until we receive payment in full and cleared funds for all sums due and owing under the Contract. Until such time that we are in receipt of all sums due and owing, we shall remain the owner of the Goods.
If we fail or delay, at any time during the term of a Contract, to insist upon strict performance by you of any of your obligations this does not mean we have given up our rights and we may still require you to comply with your obligations under the Contract.
If we forgive (in writing) any particular default by you of your obligations under a Contract, that does not forgive any subsequent default by you.
If any of these terms and conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will to that extent be severed from the remaining terms, conditions and provisions which will continue to be valid to the fullest extent permitted by law.
10. Entire agreement
We intend to rely upon these terms and conditions and any document expressly referred to in them in relation to the subject matter of any Contract. While we accept responsibility for statements and representations made by our duly authorized agents, please make sure you ask for any variations from these terms and conditions to be confirmed in writing.
11. Our right to vary these terms and conditions
The above Terms of Service constitute the entire agreement of the parties and supersede any and all preceding and contemporaneous agreements between you and SuperBath.co.uk. Any waiver of any provision of the Terms of Service will be effective only if in writing and signed by a Director of iSi GmbH.
